Used-Line.com provides a variety of services (the "Services") to both businesses dealing in Test and measurement, Laboratory and semiconductor equipment ("Providers") and individual buyers and sellers of said equipment ("Consumers"). Any new features added to this site to augment the Services shall also be subject to this TOS, as modified from time to time.
Information Accuracy. Used-Line.com cannot guarantee that either Providers or Consumers using Used-Line.com are who they represent themselves to be. Providers and Consumers using this service should take the same precautions in selling and buying as they would with other purchases.
User Responsibilities. If you are either a Provider or a Consumer using our Services, in partial consideration of your use of the Services, you agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Used-Line.com registration forms, (b) maintain and promptly update information regarding the location and contact information for your business. If you provide any information that is untrue, inaccurate, not current or incomplete, or Used-Line.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Used-Line.com has the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof). In the event Used-Line.com suspends an account for violations of this TOS or the violation or suspected violation of any state or federal law, no refund of any fees collected or other remedies will be given.
Transactions. The buyer and the seller are solely responsible for completion of transactions. Used-Line.com bears no responsibility in regard to any aspect of transactions generated from its services.
Security. You will be assigned a username and password that you can later change. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Used-Line.com of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Used-Line.com cannot and will not be liable for any loss or damage arising from your failure to comply with this
Fees. Used-Line.com charges fees for listing and banner advertising services. These fees are determined at the onset of your using our services as negotiated by email or phone. Fees are paid at the start of the service. Your monthly fees will automatically charged to your credit card monthly until you cancel you’re your subscription to the service. Once Used-Line charges your card no refund will be made for cancelled services. It is your responsibility to contact Used-Line before your billing date if you want to cancel your subscription to Used-Line services.
We may change our fees for our services for new accounts from time to time without notice. We may in our sole discretion change some or all of our services at any time. Unless otherwise stated, all Fees are quoted in U.S. Dollars. You are responsible for paying all Fees associated with using our service and our website and all applicable taxes, if any.
Registered and Non-Registered Dealer Listings. Listings in the Used-Line Database come from paying (registered) and non-paying (non-registered) dealers. Used-Line will give priority to Registered dealers in a number of ways, and may alter from time to time the manner in which Registered Dealers are differentiated from non-registered dealers. Used-Line may offer trial periods to non-paying dealers. The algorithm that determines the order of the listings is meant to give fair exposure of all registered dealers, but in no way will Used-Line be held responsible for seller position in listings, nor be responsible to answer complaints regarding the seller position in the listings. Private (non-dealer) ads appear before registered dealer ads
Automatic Download Service. The Used-Line automatic download service obtains listings information from dealer websites and from HTML pages set up especially for the Used-Line Download robot. We are not responsible for interruption of this service in the event that the dealer changes the download source or for any other problems in the download source. It is the responsibility of the dealer to notify Used-Line of changes that may interrupt the automatic download service. Equipment inserted into the Used-Line database through this service do not appear as featured items on the Used-Line website..
Manual Listing Service. Dealer is solely responsible for entering equipment ads in this service. Used-Line will not be held responsible to loss caused by errors in the Used-Line dealer system. Only items with photos uploaded to Used-Line through this service will appear as featured items. The algorithm that determines which featured items appear on any given page is meant to give fair exposure of all registered dealers, but in no way will Used-Line be held responsible non appearance of any featured item.

Limits on Use. You may not decompile, reverse engineer, disassemble, rent, lease, loan, sublicense, create derivative works from Used-Line.com which includes the information and software made available therein. You may not copy, modify, reproduce, republish, distribute, transmit or use for commercial or public purposes information provider by Used-Line.com except to the extent required in order for you to use Used-Line.com.com in the manner expressly intended by Used-Line.com.
Intellectual Property. Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, video clips, and written and other materials that are part of the Used-Line.com web site are copyrights, trademarks, trade dress and/or other intellectual properties owned, controlled or licensed by Used-Line.com. Information, images, pictures and descriptions posted by Providers and Consumers ("User Information") may or may not be subject to copyright or other rights of third parties. You hereby grant Used-Line.com a nonexclusive, fully paid up, royalty free, irrevocable right to utilize your User Information solely for the purposes intended herein. Providers and Consumers are fully and solely responsible for the materials they post, and Used-Line.com is not responsible for their content. Please ensure that any materials posted to Used-Line.com comply with all applicable state and Federal laws. Used-Line.com reserves the right to remove without notice any materials it has reason to believe or suspect may violate copyright or other laws. No material from this Web site may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way, except as otherwise explicitly permitted herein. Modification of the materials or use of the materials for any other purpose is a violation of Used-Line.com's copyright and other proprietary rights. For purposes of these terms, the use of any such material on any other Web site or networked computer environment is prohibited, except as otherwise permitted herein. All trademarks, service marks, and trade names are proprietary to Used-Line.com.
You may not copy or adapt the HTML code or other scripts that Used-Line.com creates to generate its pages. They are also protected by Used-Line.com's copyright. .
Fraud. Without limiting any other remedies, Used-Line.com may suspend or terminate your account if you are found (by conviction, settlement or otherwise) to have engaged in fraudulent activity in connection with our site.
User Representations, Warranties and Indemnity. You warrant and represent that the information you provide about yourself and the goods you offer on Used-Line.com is true, accurate, current, complete and complies with all applicable state and federal laws.
You agree to indemnify and hold harmless Used-Line.com for any claim including damages, costs and reasonable attorneys' fees incurred by Used-Line.com arising from a breach of the foregoing warranties and representations or any breach of this TOS.
Disclaimer of Warranties. Used-Line.com endeavors to provide excellent and accurate services. Nonetheless, you expressly understand and agree that:

Limitation of Liability. NOTWITHSTANDING THE ABOVE, THE USED-LINE.COM'S TOTAL LIABILITY FOR ANY DAMAGES SHALL BE LIMITED TO THE TOTAL FEES PAID BY THE CUSTOMER TO USED-LINE.COM FOR SERVICES OVER THE PRECEEDING MONTH.
